GENERAL DESCRIPTION

Performs moderately to advanced professional legal work for the Market Analysis Division. Work includes

analyzing complex issues related to electric markets with a focus on ERCOT wholesale and retail competitive

markets and utilities regulation; monitoring ERCOT Stakeholder process for developing legal opinions; and

participating in contested case proceedings, rulemakings, legislative analysis, and policy development. Work

involves extensive collaboration with market economists, engineers, industry stakeholders, and other

professional staff. Works under general to minimal supervision with moderate to considerable latitude for the

use of initiative and independent judgment.

ESSENTIAL FUNCTIONS

• Provide legal expertise and analysis related to competitive electric markets, regulated electric utilities, and

infrastructure planning; may address issues related to the agency’s oversight of the telecommunications and

water and wastewater industries.

• Monitor and provide legal expertise related to activities conducted by the Electric Reliability Council of Texas

(ERCOT) and ERCOT stakeholder committees, as well as other state agencies, Midwest ISO (MISO),

Southwest Power Pool (SPP), and the Federal Energy Regulatory Commission (FERC).

• Participate in the investigation of issues relevant to the electric industry and assist in the preparation of

reports on electric reliability and operations, market efficiency, market power, service availability, and other

related matters.

• Communicate with management on policy and market issues by preparing written briefing materials that

summarize and evaluate applicable law and participate in policy development and rulemaking activities in

coordination with other divisions, including conducting legal research and preparing recommendations and

supporting documentation for Commission action.

• Provide information and represent the agency, regarding Commission policies and procedures to industry

stakeholders, customers, legislative personnel, other government agencies, and the public; collaborate with

the Legal Division and other Commission staff to support the oversight of rules and protocols related to the

electric market.

• Track contested cases and stay informed of issues being addressed; provide legal advice and

recommendations; work with subject matter experts, including economists and engineers to prepare written

or oral expert testimony for contested proceedings; assist with cross-examination, and collaborate with

professional staff throughout all stages of proceedings, including pre-hearing through post-hearing activities.

• Represent the public interest by advocating Commission staff’s positions in contested cases at the

Commission and State Office of Administrative Hearings (SOAH).

• Review uncontested filings for consistency with Commission policies, rules, and orders.

• May be required to travel out of state for trainings and meetings.

• Attend work regularly and observe approved work hours in accordance with agency leave and attendance

policies.

• Adhere to all PUC personnel policies and division procedures and perform other work as assigned.

EFECTIVE DATE: 05/01/26MINIMUM QUALIFICATIONS

• Attorney II: Graduation from an accredited law school with LLB or JD degree and licensed with the State Bar

of Texas and eligible to practice law in Texas; and a minimum of two (2) year legal work experience as a

licensed attorney.

• Attorney III: Graduation from an accredited law school with LLB or JD degree and licensed with the State Bar

of Texas and eligible to practice law in Texas; and a minimum of three (3) years legal work experience as a

licensed attorney, preferably in utility regulation or administrative law.

• Attorney IV: Graduation from an accredited law school with LLB or JD degree and licensed with the State

Bar of Texas and eligible to practice law in Texas; and a minimum of four (4) years legal work experience as

a licensed attorney, preferably in utility regulation or administrative law.

PREFERRED QUALIFICATIONS

• Experience in utility regulation, administrative law, or electric markets.

• Degree in economics, engineering, business administration or public policy.

• Experience with litigation or administrative law experience as a licensed attorney.

• Experience supporting or advising on electric market operations, regulatory proceedings, or policy

development involving at federal or state level including ERCOT, or other RTO/ ISO organizations, or

electric utilities.
